1. Acceptance of Terms

By downloading, accessing, or using the PlushMation mobile application, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.

2. Service Description

PlushMation is a mobile application that uses artificial intelligence to transform photos of plush toys into animated videos. The service includes:

  • AI-powered video generation from uploaded plush toy images
  • Processing and storage of generated animations
  • Credit-based usage system
  • Cloud-based content storage and delivery

3. Content Ownership and License

Your Content: You retain ownership of all original photos and images you upload to PlushMation.

License to Us: By uploading content, you grant PlushMation a non-exclusive, worldwide license to:

  • Process your images using AI technology
  • Generate animated videos based on your content
  • Store and deliver generated content back to you
  • Improve our AI algorithms and services

Generated Content: You own the animated videos created from your original content, subject to these terms.

4. Credit System and Payments

Credit Purchases: Animation generation requires credits purchased through in-app purchases processed by RevenueCat.

  • Credits are non-refundable and do not expire
  • Credits are consumed when animation generation begins
  • Failed generations due to technical issues may result in credit refunds at our discretion

Refund Policy: Generally, no refunds are provided for credit purchases. Exceptions may be made for technical failures or billing errors.

5. Prohibited Content and Use

You may not upload or generate content that is:

  • Inappropriate, offensive, or harmful
  • Contains copyrighted material you don't own
  • Depicts real people without consent
  • Not age-appropriate or contains adult content
  • Used for commercial purposes without proper licensing

You also may not attempt to reverse engineer, hack, or misuse our AI services.

6. Service Availability

We strive to maintain service availability but do not guarantee 100% uptime. The service may be temporarily unavailable due to maintenance, updates, or technical issues. We are not liable for any interruptions to service availability.

7. AI Processing and Third-Party Services

PlushMation uses third-party AI services (including but not limited to Minimax) to process your content. By using our service, you acknowledge that your content may be processed by these external providers in accordance with our Privacy Policy.

8. DMCA and Copyright

We respect intellectual property rights. If you believe your copyrighted work has been infringed, please contact us at hi@plushmation.com with details of the alleged infringement.

9. Account Termination and Data Deletion

Your Right to Delete: You may delete your account at any time through the app settings or by contacting us at hi@plushmation.com

What Happens When You Delete Your Account:

  • Your account information will be permanently deleted within 30 days
  • All generated videos you created will be permanently deleted
  • Original uploaded photos will be deleted immediately
  • Any remaining credits will be forfeited (non-refundable)
  • Usage analytics may be retained in anonymized form for service improvement

Our Right to Terminate: We reserve the right to suspend or terminate accounts that violate these terms, with or without notice.

10. Limitation of Liability

To the maximum extent permitted by law, PlushMation shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising from your use of the service.

11. Governing Law

These Terms of Service are governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.

12. Changes to Terms

We reserve the right to modify these terms at any time. Material changes will be communicated through the app or via email. Continued use of the service after changes constitutes acceptance of the new terms.
